Terms of Service

These Terms of Service (“Terms”) govern your access to and use of SMT-CRM software, related services, documentation, and support provided by SMT Constructions (“we”, “us”, or “our”). By purchasing a license or using the software, you agree to these Terms.

If you are using SMT-CRM on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Upon purchase, SMT Constructions grants you a non-exclusive, non-transferable license to install and use SMT-CRM for your internal business operations for the duration of your subscription.

You may not:

• Resell, sublicense, or redistribute the software without written permission
• Remove or alter any copyright, trademark, or proprietary notices
• Use the software for any unlawful purpose
• Reverse-engineer or decompile the software beyond what applicable law expressly permits

SMT-CRM is offered on a subscription basis. Subscriptions are billed monthly or annually as selected at checkout via PayPal. All prices are in USD.

Annual subscriptions are charged as a single upfront payment. Monthly subscriptions are charged each calendar month. Prices are subject to change with 30 days' notice.

Your subscription auto-renews unless cancelled before the renewal date. You can cancel at any time through PayPal's subscription management or by contacting us at info@smtconstructions.com.

We offer a 30-day money-back guarantee on new subscriptions. If you are not satisfied within the first 30 days, contact us for a full refund. After 30 days, subscriptions are non-refundable.

One-time services (installation, setup) are non-refundable once the service has been performed.

For self-hosted licenses, you are solely responsible for the server, infrastructure, security, and backups. SMT Constructions provides the software “as-is” for self-hosted deployments and is not responsible for data loss, downtime, or security breaches on your infrastructure.

If you purchase the managed cloud add-on, SMT Constructions will provision and maintain your SMT-CRM instance. We target 99.5% uptime but do not guarantee it. Planned maintenance windows will be communicated in advance.

Your data is backed up daily. In the event of cancellation, you will receive an export of your data within 7 business days upon request.

You agree not to use SMT-CRM to:

• Send unsolicited bulk email (spam)
• Store or process illegal content or data
• Violate any applicable privacy regulations (GDPR, CCPA, etc.)
• Interfere with other users' use of the software

SMT-CRM is based on Zurmo CRM (open-source, Affero General Public License). Our customizations and branding are the property of SMT Constructions. Your data remains your property at all times.

THE SOFTWARE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMT CONSTRUCTIONS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

IN NO EVENT SHALL SMT CONSTRUCTIONS BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

These Terms are governed by the laws of the jurisdiction in which SMT Constructions operates. Any disputes shall be resolved through good-faith negotiation, followed by binding arbitration if necessary.

We may update these Terms at any time. Material changes will be communicated by email to registered subscribers. Continued use of SMT-CRM after the effective date of changes constitutes acceptance.
